The Court of Appeal sitting in Abuja has dismissed the interlocutory appeals filed by the Osun State chapter of the All Progressives Congress (APC) seeking a stay of execution on the judgment regarding local government administration in the state.
The legal proceedings center on the disputed tenure of local government officials in Osun State following a Federal High Court judgment. The APC had approached the appellate court to halt the enforcement of the lower court’s decision dismissing their tenure elongation suit.
During the court session, the interlocutory applications brought by the APC were withdrawn and subsequently dismissed by the appellate panel. The court noted that the main appeal challenging the final judgment of the Federal High Court could not proceed as scheduled, as several key parties involved in the suit had not yet been formally served with the court processes.
Consequently, the Court of Appeal adjourned the substantive appeal on the tenure elongation suit to allow for proper service on all necessary parties. The court has instructed its registrar to ensure that all required legal notices and court documents are served on the relevant parties, including security agencies and electoral authorities.
